Telephone Preference Service
Telephone Preference Service (TPS) is operated by the Direct Marketing Association (DMA). Individuals wishing to join the TPS should contact them directly. The TPS scheme allows individuals to opt out of unsolicited telemarketing calls. The register includes the telephone number of individuals who do not want to be contacted for unsolicited marketing.
The term 'individual' includes:
- Consumers at their residential address
- Sole traders
- Partnerships (except in Scotland)
How does Telephone Preference Service affect your business?
If you use telemarketing to promote your business you should check if TPS use applies.
TPS is a legal requirement where:
- You are making an unsolicited telemarketing call to an individual (as defined above)
- An unsolicited marketing call is a marketing call where you do not have permission to call this individual for marketing purposes
If TPS use applies, then you must screen your call list at least 90 days before calling.
Non compliance
If you make an unsolicited direct marketing call to a number registered on TPS, the Information Commissioners Office can fine you up to £5,000.
